Apartamenty Podhale

These Terms and Conditions apply to the facilities of Apartamenty Podhale in Zakopane, located at ul. Szymony 17E, 34-500 Zakopane - Cieślak-International Sp. z o.o., ul. Skrajnia 20, 62-814 Blizanów, NIP [Tax ID] 9680929939, hereinafter referred to as the Facility.

Persons who stay at the Facility shall hereinafter be referred to as Guests.

The person who pays the booking fee at the Facility shall hereinafter be referred to as the Lead Guest.

 

 

Dear Guests, In order to ensure your peaceful and safe stay at Apartmenty Podhale, we kindly ask you to read and obey the following Terms and Conditions.

 

SECTION 1. PURPOSE OF THE TERMS AND CONDITIONS

1. These Terms and Conditions define the principles for the provision of services, scope of liability and terms of stay on the premises of Apartamenty Podhale and form an integral part of the agreement concluded at the check-in at Podhale Apartments, as well as by making a booking and payment of a non-refundable booking fee.

By doing so, the Guest confirms that he/she has read and accepts the Terms and Conditions.

 

2. The Terms and Conditions are binding for all Guests staying at Apartmenty Podhale.

3. The Terms and Conditions are available in each apartment or from the administrative staff. They are also sent by e-mail to Guests when making a booking.

 

SECTION 2. CHECK-IN AND CHECK-OUT

1. The apartments are available from the check-in time until the check-out time on the following day.

2. Check-in is from 4 p.m., while check-out is by 11 a.m. on the following day.

3. Failure to vacate the apartment after 11:00 a.m. shall be treated as an extension of your stay.

4. Any requests for extension of the stay should be reported by the Guests to the administrative staff as soon as possible. The administrative staff of Apartmenty Podhale reserves the right to refuse the request for the extension of the stay in case there are no vacancies or if the Guests do not observe the terms and conditions in force.

 

SECTION 3. BOOKING AND CHECK-IN

1. When checking-in, the Guest are required to present their ID with a photo to the staff of Apartmenty Podhale.

2. Persons who are not checked-in at the Facility may stay in the hotel rooms from 8:00 a.m. to 9:30 p.m.

3. The Facility may refuse to accommodate a Guest who, during the previous stay, grossly violated the Terms and Conditions, in particular by causing damage to the property of the Facility or other Guest's property, inflicting harm on other Guests, the Facility's staff or other persons staying at the premises of Apartmenty Podhale.

4. In the event of cancellation, force majeure, forced quarantine or non-arrival of the Guest, the booking fee shall not be refunded.

5. A non-refundable fee of approx. 50% of the total price is required when making a booking.

6. Bookings can be made by e-mail or through the website of ApartamentyPodhale.pl. The Lead Guest who makes the booking is obliged to provide a contact number, personal details of the Guests and an e-mail address to which a confirmation of the booking will be sent after payment of the booking fee. The Lead Guest is obliged to reply to the above message.

7. Any changes to the booking can be made up to 10 days before the planned check-in, provided that the minimum number of nights and Guests indicated in the first booking made via www.apartamentypodhale.pl is kept and provided that the apartment has not already been booked on the new date proposed by the Lead Guest. When changes to the booking are no longer possible and the Guest has withdrawn from the agreement, cancelled the booking or has not appeared at the Facility on the check-in date, the Facility is entitled to retain the non-refundable booking fee paid. Changes to the booking are possible up to six months after the initial booking.

8. The Facility may change the date of the booking only in the event of force majeure, beyond the control of the Facility, which prevents the proper performance of the service. Force majeure shall be understood, in particular, as natural disasters, strikes, wars, riots, seizure of the Facility by government authorities, long-term interruptions in power, gas or heat supply by the supplier of these utilities, beyond the control of the Facility.

9. In cases described in point 6, the Guest will be offered another available reservation date.

10. Apartamenty Podhale reserves the right to offer, in exceptional situations (failure in the apartment or other fortuitous event), substitute accommodation of a similar standard in another accommodation facility. If the Guest agrees to a substitute accommodation, the agreement shall be terminated.

11. A deposit of PLN 500 per apartment is charged at check-in. The deposit shall be refunded upon check-out, once the Apartment has been inspected by the staff of Apartamenty Podhale.

12. In the event of complaints or objections regarding the quality of the services provided, the Guests are requested to report them immediately to the staff in order for us to immediately take appropriate steps and clarify the situation.

 

SECTION 4. SERVICES

1. The Facility provides services in accordance with its category and standard.

2. 12. In the event of complaints regarding the quality of the services provided, the Guests are requested to report them immediately to the staff of the Facility, so that we can attempt to improve their standard.

3. If the Guest does not report any complaints or objections regarding the technical condition of the apartment or bungalow upon check-in, this shall mean that the apartment has been made available to the Guest in a satisfactory condition.

4. The invoice for the stay is issued by the administrative staff of the Facility on the day of check-out.

5. Apartmenty Podhale is obliged to provide the Guests with:

- appropriate conditions for comfortable and peaceful rest,

- temperature in the rooms of at least 21.5°C,

- safety during the stay, including the confidentiality of the Guest's personal data,

- professional and courteous customer service with regard to all services provided by the Facility,

- cleaning service of the room on the Guest's special request for an extra charge of PLN 180, as well as performance of necessary repairs in the room in the absence of the Guest (performing such repairs in the Guest's presence requires his/her consent).

- for a stay with breakfast included - breakfast served to the apartment. Breakfast is served 7 days a week, from 7:00 a.m. to 8:00 a.m. If you would like take-away breakfast, please notify the administrative staff the day before, during your stay or upon check-in.

6. Any items left by Guests after vacating the apartment may be sent back at the Guest's expense to the indicated address. Otherwise, after five days from the Guest's check-out date, the administrative staff of the Facility will deal with the items according to the regulations concerning lost or found items.

 

SECTION 5. OBLIGATIONS OF THE GUESTS

1. Children under 12 years of age staying on the premises of Apartamenty Podhale should be under the constant supervision of their legal guardians. Legal guardians shall be responsible for any damage caused by their children.

2. The Guest is obliged to notify the administrative staff of the occurrence of the damage immediately upon its discovery.

3. The Guests of Apartmenty Podhale bear full financial responsibility for any damage or destruction of equipment in the booked apartment or the entire Facility, caused either by the Guests themselves or their visitors. The Facility reserves the right to charge the Guests with a fine for the damage caused.

4. In the event of a breach of the Terms and Conditions by a Guest, Apartamenty Podhale may refuse to provide services to the person who has committed it. Such a person shall be obliged to immediately comply with the demands of the Facility and pay for previous services, as well as any damage caused and leave the Facility.

5. For safety reasons, each time a Guest leaves the apartment, he/she should switch off the TV, turn off the lights, close the taps, close the windows and lock the door.

6. The apartment should be left in the same condition as on the day of the Guest's arrival. Guests are not allowed to make any changes to the apartment or its furnishings, apart from slight rearrangement of furniture and equipment, which does not affect its functionality and safety of use.  The administrative staff of the Facility may request that the apartment be returned to its condition prior to the Guest's stay.

7. Subletting the apartments to third parties is strictly prohibited.

8. The apartments may not be used for any purposes other than for accommodation.

9. In the event of losing the key to the Apartment or the main entrance, or handing them over to a third party, the Facility has the right to charge the Guest a fee of PLN 500-1500, depending on the extent of the damage.

10. The Guests are obliged to close the windows during the heating season when leaving the apartment. Otherwise, the Facility reserves the right to charge the Guest with a fine of PLN 250.

11. Wearing ski equipment and ski boots in the Facility and in the apartments is strictly prohibited.

 

SECTION 6. OBLIGATIONS OF APARTAMENTY PODHALE

1. The administrative staff cannot accept responsibility for money, documents, jewellery and other valuables left in the apartments.

2. The administrative staff cannot accept responsibility for damage or loss of a car or other vehicle belonging to a Guest, or items left inside it, regardless of whether these vehicles were parked in the underground car park or outside the premises.

3. The staff of the Facility reserves the right to enter the apartment in order to clean it, change towels, change bed linen, close windows, check the heating system or electrical appliances and repair them if necessary.

 

SECTION 7. QUIET TIME

 The quiet time in the Facility is from 10 p.m. to 7 a.m.

 

SECTION 8. SMOKING

1. Smoking on the premises of Apartamenty Podhale on its immediate surroundings is strictly prohibited, except in designated places (on the balconies/terraces and in front of the main entrance to the building).

2. Smoking inside the building is strictly prohibited.

3. Smoking is permitted on the balconies of the apartment provided that fire safety rules are observed and the door to the apartment is closed.

4. In the event of violation of the smoking ban, the Facility has the right to charge the Guest with a fine in the amount of PLN 600.

5. The Facility is equipped with smoke and fire detectors connected to the alarm system of the Facility. It is strictly prohibited to cover the smoke detectors. The Facility reserves the right to charge the Guest a fine for the damage caused and to terminate the agreement immediately.

 

SECTION 9. PETS

1. Pets are not accepted in the Facility.

 

SECTION 10. ADDITIONAL SERVICES AND INFORMATION

1. In order to ensure the safety of the Guests, security cameras monitoring the facility and the car park are installed both inside the building (staircase) and outside the Facility.

2. For fire safety reasons, it is prohibited to use coil heaters, blow heaters, radiators or similar devices that are not provided in the apartment.

3. Irons and ironing boards are provided in the apartments.

6. There are smoke detectors in each room.

7. The Guests are asked to switch on the hood when using the induction cooker in the apartment.

8. It is prohibited to walk around the Facility in dirty, muddy shoes or ski boots.

 

 

SECTION 11. INFORMATION CONCERNING PERSONAL DATA OF THE GUESTS OF APARTAMENTY PODHALE

PERSONAL DATA CONTROLLER

 

1. PURPOSES OF PROCESSING PERSONAL DATA OF THE GUESTS

The Facility processes personal data in connection with the conclusion and execution of the agreement for the provision of hotel services. In addition, the Facility processes personal data for the following purposes:

2.a - to pursue potential claims by the Facility in connection with damage caused by the Guest or to defend against the Guest's claims,

2.b - to document the performance of the service for tax purposes,

2.c - to provide the highest quality of services to the Guest of the apartments.

If the Guest has consented to the processing of his/her personal data for marketing purposes, the Facility may send him/her marketing information and offers about its products and services. In addition, Apartamenty Podhale processes the Guests' personal data collected by the Facility's monitoring system in order to ensure the security of the Facility's Guests and other persons staying on its premises.

 

2. LEGAL BASIS OF PERSONAL DATA PROCESSING

1. The legal basis for the processing of the Guest's personal data collected by the Facility is the concluded agreement for the provision of hotel services.

The legal basis for the processing of the Guest's personal data used for marketing purposes is the Guest's consent. The consent referred to above may be withdrawn at any time. Such withdrawal shall not affect the validity of the processing prior to the withdrawal of the consent. The legal basis for the processing of the Guest's personal data collected by the monitoring system is the protection of the Guest's vital interests and the protection of the vital interests of other natural persons, as well as the legitimate interest of the data controller. The legal basis for the processing of the Guest's personal data in connection with the provision of the highest quality services to the Guests of Apartamenty Podhale is the legitimate interest of the data controller.

 

3. GUESTS’ RIGHTS IN RELATION TO THE PROCESSING OF THEIR PERSONAL DATA
Each Guest has the right to access their personal data, rectify, delete it or restrict its processing. In addition, each Guest has the right to object to the processing of his/her personal data. The data can be accessed at the premises of the Facility. Guests may contact the Facility concerning personal data matters via e-mail at rezerwacja@apartamentypodhale.pl.

 

4. OBLIGATION TO PROVIDE PERSONAL DATA
Providing personal data (name, address, email address; in the case of online bookings, telephone number; age of children who will be staying at the Facility with the Guests; and vehicle registration number, if the Guest's vehicle will be parked on the Facility's premises) is required for the conclusion of the agreement for the provision of hotel services. Failure to provide personal data will prevent the Facility from concluding an agreement for the provision of hotel services with the Guest.
